The H2B program offers numerous benefits for employers, including:

To qualify for the H2B program, employers must meet the following requirements:

  • Be a U.S. employer with a job opportunity located within the U.S. for temporary or seasonal non-agricultural work
  • Justify the need for the duties to be performed under a one-time occurrence, intermittent, seasonal, or peak-load need
  • Demonstrate a need that is a year or less in duration
  • Offer wages to foreign workers that are equal to the prevailing wage rate paid to U.S. workers for the same job
The duration of the program is limited to a year or less, but may be extended for an additional two years in certain circumstances. To ensure timely processing, employers should start the application process at least five months prior to the arrival date of their workers.
 
Note that the H2B program is subject to an annual numerical limit, or "cap," of 66,000 workers per fiscal year. However, foreign workers who are eligible for H2B status as "returning workers" do not count against this cap.
